Márcia Gonçalves – European Directive for the Protection of Handcrafted and Industrial Products in the Union
“Regulation (EU) 2023/2411, of October 18, 2023, establishes a system for the protection of handcrafted and industrial products in the EU through a simple and efficient registration that provides reliable information and ensures the authenticity of the covered products. It also establishes measures for the verification and monitoring of GIs of handcrafted and industrial products and their commercialization throughout the Union’s territory, which will favor local economic development and contribute to the protection of know-how and common heritage. The European Union Intellectual Property Institute (EUIPI) will be responsible for managing the registration of this right in the EU. “Handcrafted and industrial products” are understood as those “entirely handmade, or with the help of manual or digital tools, or by mechanical means, whenever manual contribution is an important component of the finished product” or products that are “manufactured in a standardized manner, including mass production and using machines.””
“Examples of handcrafted and industrial products, whose protection was limited to national territory and can now benefit from expansion throughout the EU, include the Embroidery of Viana do Castelo (GI registered at INPI under no. 136), the Filigree of Portugal (GI registered at INPI under no. 539), the Bobbin Lace of Peniche (GI registered at INPI under no. 611), and the Black Pottery of Molelos (GI registered at INPI under no. 617), among many others.”
